1. Acceptance of Terms

By accessing or using Pensa ("the Service"), operated by Pensa ("we," "our," or "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

2. Description of Service

Pensa is a mindful shopping tool that helps you save products from across the web, organize them by priority, track spending, and make intentional purchase decisions. The Service includes:

  • A web application at usepensa.com
  • A Chrome browser extension
  • A mobile application (coming soon)
  • Related APIs and services

3. Account Registration

To use the Service, you must create an account using a valid email address or Google sign-in. You are responsible for:

  • Maintaining the security of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized use

You must be at least 13 years of age to use the Service. By creating an account, you represent that you meet this requirement.

4. Alpha Program

Pensa is currently in private alpha. During this period:

  • The Service is provided free of charge
  • Features may change, be added, or be removed without notice
  • The Service may experience downtime or interruptions
  • We may limit the number of users or invitations
  • We may transition to a paid model in the future with advance notice

5. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Attempt to gain unauthorized access to any part of the Service
  • Interfere with or disrupt the Service or its infrastructure
  • Use automated tools to scrape, crawl, or extract data from the Service
  • Upload malicious content or attempt to exploit vulnerabilities
  • Impersonate another person or entity
  • Use the Service to violate the intellectual property rights of others
  • Resell, redistribute, or sublicense access to the Service

6. Your Content

You retain ownership of all data you submit to the Service, including your product lists, notes, and preferences ("Your Content"). By using the Service, you grant us a limited license to store, process, and display Your Content solely for the purpose of providing the Service to you.

Product information (titles, prices, images) fetched from third-party websites remains the property of those respective websites. Pensa displays this information for your personal, non-commercial use only.

7. Third-Party Content and Links

The Service allows you to save links to third-party websites and fetches publicly available product information from those sites. We are not responsible for:

  • The accuracy, availability, or content of third-party websites
  • Changes in product prices, availability, or descriptions
  • Any transactions you make on third-party websites
  • The privacy practices of third-party websites

Pensa is not a shopping platform and does not facilitate purchases. All buying decisions and transactions occur directly between you and third-party retailers.

8. Intellectual Property

The Service, including its design, code, logos, and branding, is owned by Pensa and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Service without our written permission.

The Pensa name, logo, and related marks are our trademarks. You may not use them without our prior written consent.

9. Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your information.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or secure, or that any defects will be corrected. Product prices and information displayed in the Service may not be current or accurate.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PENSA SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR $50, WHICHEVER IS GREATER.

12. Account Termination

You may delete your account at any time through the Settings page or by contacting us. We may suspend or terminate your account if you violate these Terms or if we discontinue the Service.

Upon termination, your right to use the Service will cease immediately. We may retain certain data as required by law or for legitimate business purposes.

13. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the updated Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with applicable law, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved through good-faith negotiation, and if necessary, binding arbitration.
